How to claim money back in case of checque bounce

one of my freind has borrowed an amt from me 3 years ago against which i he issued me a cheque mentioned with amt & his signature only...From last 2 years i am requesting him to pay back but he is not responding ...just want to know how can i get my amt back from him?

You can claim your amount by filing a suit against your friend. Or you can file a u/s 138 of negotiable instrument act. You haven't mentioned your amount hence am unsure to give you the best remedy but this two ways are available

Dear client first file cheque in bank and if cheque get bounced due to insufficient fund then send legal notice through lawyer within 30 days to him. If he will not return money then file case in court under Sec 138 of n I act. For any legal help call me

deposit the cheque in to your bank for realisation, let is bounce with the reason insufficient fund. thereafter follow the procedure of section 138 of N.I. act under which you have to send a legal notice to him within a month from cheque bounce asking for refund of money within 15 days, if still not paid to you file a case in criminal court within 45 days from the date of sending the notice to him.

It appears from your query that you don't have any receipt of amount paid by you in writing. The only document you have is undated cheque. You can use that cheuqe by putting date on it. Be sure and try to use same pen or pen with same ink. Prsent it and if gets dishonored file complaint under section 138 of Negotiable Instruments. Act

Simple filed 138 under negotiable instruments act 1881 in which you can pray for getting money back .
It is simple process not much legal fees
There are many legal way but section 138 is much better
