Filling case against a bank on dishonored cheque

Dear Sir, Our buyer issued us PDCs of Axis bank. Cheques were dishonoured twice. The buyer is now absconder, and not traceable. Can we file a case against Axis bank to recover our money? If yes, on what ground? If no, what is the base? - Regards, Ruchir Shah 9825729129

No Axis bank is not liable in the said case, as the default is on the part of the said buyer, bank is just an institution providing its service to its customers. Now, all you can do is to file a complaint in the nearest police station, followed by a letter to the SP of the said area. After that the police will inquire into the details of the said buyer, with reference to its account number. After that you can file a criminal case for dishonour of cheque under the provisions of Negotiable Instruments act.
