Cheque bounce which is given as a security

We were accepting a loan. A known person came to us for providing a loan.its taking so long so he provide 15000 on interest as 500 per day for some time. But it goes on he failed to provide us loan. We cudnt give him the interest as he demand so he took those chaques as security .whenever he provide us loan he we will pay the interest. But after long time he cudnt do so. So he present those blank chaques in bank without telling us.get them Bounced and file case. He gave us notice which we have answered that he is doing froud. We fought that case till 10 years. Its in high court nw. Wt cn we do

The law is clear in this regard, 138 proceedings does not lie if the cheques have been given as security.
138 lies only when the cheques were issued in discharge of some legally enforceable debt or liability.
However, in your case, the trial has been happened, and everything depends upon what has come into trial, what facts have been emerged in trial. The conclusion of the case takes place on the basis of the evidences established during trial.
