Cheque bounce of AMR Infrastructure due to frozen account what to do

Cheque issued as a refund/ cancellation of booked property by AMR Infrastructure Delhi, now the accou has been frozen by EOW of Delhi Police Mandir Marg Delhi, how should I proceed against the party , should I deposite the chk first let it bounce or wait for replacement offered by the party who is not much trustable
Deposite the cheque in the account in issue get it bounced after that issue notice trough Advocate u/s 138. Take all the steps. If after service any proposal is being put to you which is acceptable to you, you may settle the matter. But in case you are not taking step it is unexpected that the other party would even try to contact you. There is possibility of lossing your case due to limitation of law. So it is advisable that take every steps promptly in accordance with law.

You can issue a legal demand notice to builder through advocate and if he doesn't respond to notice and pay the amount you can file a complaint under section 138 of Negotiable Instruments Act. check that all is done within limitation period as required under Section 138 to Section 142 of Negotiable Instruments Act. The Case can be filed with Judicial Magistrate First Class (Metropolitan Magistrate) Court

It is better to deposit the cheque and get it bounced, then a notice has to be given for repayment and if the amount of cheque is not paid, then a cheque bounce case can be filed. Never ever return the cheque because once the cheque is returned then they might not issue a new cheque or make payment. As cheque bounce case is a criminal matter, there are more chances of you getting the money back. Otherwise, a civil matter has to filed which may take years.
