Dear client,
You have not furnished full particulars of your matter. Whether you have issued blank singed cheque or not and also at the time of you obtaining loan whether you have issued any blank signed pronotes or other documents. It is always wrong to give blank signed documents at the time of obtaining loan. You ought to have put date amount etc., particulars and you must fill documents otherwise lender will do the same. You must prove the same in the court by placing evidence in the case that will be filed by lender. You must issue notice to your bank official that the lender obtained blank signed cheque and not to honour the same. You must also establish your case by lodging police complaint, that lender obtained blank signed cheque and threatning you to file a wrong case. You must publish the same in a news paper and also issue a notice to the lender to return the blank signed pronotes, cheques and other related documents that were obtained by him at the time of lending the amount to project your case before the court.

When did you take the loan. And how much interest have you paid till recently. If you are due on principal amount you have to pay. After payment you can claim your cheque back simultaneously with the payment. Otherwise he will use the cheque. If you had given a blank cheque then he can put a date on it and that is the starting point of limitation as the cheque has to be presented within 3 months from the date mentioned on the cheque.
