Cheque bounce how to recover the amount

Sir, i have given some rupees to a property developper for a property but because of few reason i didn't want to purchase the plot n i demanded my money back. The developper had given few amount in cash an remaining 1'10'000 in form of 2 check of 55000 each . date of issue of the check was 29 jun 2015 but he had put the withdrawl date on a check as 5 aug and on other check it was 10 aug 16. After 2 bounce the first check was encashed but other check was bounced 3 times because of insufficient fund. The developer then ensured me to pay the money soon but he has not paid my 55000 till now.

After the cheque is bounced you are bound to send the concerned person a legal notice for initiating proceedings under section 138 of Negotiable Instruments Act.

If within 15 days the payment is not made you can register a complaint under section 138 of NI act which is a criminal proceeding. This needs to be filed within 30 days of the completion of 15 days of the notice delivery date.

Alongwith that you can file a recovery suit / summary suit in the concerned civil court simultaneously.
