Cheque bounce he is not giving me money

Person has given me repayment cheque and payment has failed to give me cheque is bounce

If the cheque given for repayment has bounced due to insufficient funds or any other reason, you have the right to file a case under Section 138 of the Negotiable Instruments Act. First, send a legal notice to the drawer within 30 days of receiving the bank memo stating the cheque bounce. If payment is not made within 15 days of the notice, you can proceed with a criminal complaint before the Magistrate within 30 days. You may also consider a civil recovery suit for the amount. Keep all documentary proof like the bounced cheque, bank memo, and your legal notice copy.

Provided that the commercial transactions took place within 3 years. and that the cheque is dishonored then you can file a complaint under section 138 of N.I. Act. A legal notice is to be sent within 15 days of the bounced cheque memo.

if your cheque is bounce and person not giving you money then u have to contact advocate in hurry because after cheque bounce you have to take cancel memo from bank where u tried to withdraw your cheque and after that ur first preference to be sent a legal to notice to that person about cheque bounce in limitation of 30 days...

Within 30 Daya of cheque bounce you are eligible to send a legal notice for the recovery of the amount under the negotiable instrument act , once the date is passed it will be not entertained .So send a legal notice .
