Cheque Bounce happened last week

Cheque Bounce date :12/02/2019 Reason : Insufficient balance memo given by Bank to me. Amount: INR Eleven Lakh only The amount is high, what are the documents shall i require to send legal notice to Party. Court require Bank statement or Income tax return from me.

The requirements for and ingredients in the notice though appears to be simple but are needs careful and expertise in drafting to set the foundation for court processing. Limitation to send notice is 30 days from dishonour. It will only benefit you to approach a lawyer for drafting and following with case.

Dishonor of cheque or cheque bounce occurs when a cheque that is presented in the bank is returned unpaid. It could occur due to insufficient funds in the bank account of the person who issued the cheque or if the signatures on the cheque do not match with the original signature of that person. You can proceed against the person who has issued such a cheque under various provisions of law. The most important and useful provision to consider is Section 138 of The Negotiable Instruments Act.
