My customer gave a cheque to me which was bounced. What is the procedure to file a cheque bounce case in Cuttack. Tell me please.
Demand Notice is the first step in cheque bounce case. If the payer / drawer of the cheque fails to pay the cheque amount within 15 days of receipt of the demand notice then file a private complaint before the Jurisdictional Magistrate.
Upon appearance of the accused / drawer of the cheque file an application under Section 143 A of the Negotiable Instrument Act for an interim compensation which can be upto 20 % of the cheque amount.
File your evidence affidavit and adduced your evidence before Court. The opposite party will cross examine the payee of the cheque.
After closure of the evidence and argument judgement will be passed and the aggrieved party can prefer an appeal.

You have to send them a Demand Notice by a lawyer only within 30 days of the return memo being produced to you. Further, after expiry of 15 days from the receipt of the demand notice to the other party and within 30 days after the expiry of 15 days, you have to initiate a case before the District Court, Cuttack. Cheque bounce cases are criminal offence.
