Check Bounce case / Other party missed mediation dates

Hi,
We have a cheque bounce case of 5 lac.
My father is the accused. My brother took a blank check from him and gave it as a gurentee to Taj hotel in gurgoan to use as debts.
We got a lawyer who took us to mediation however the other party's lawyer was the son of a renowned high court judge - our lawyer found himself confused and defeated.
Currently, The other party didnt show up on last 2 dates of mediation. Next date in court is in first week of august. I want to know what is next if mediation didnt come out with any result. Also, We want to pay but currently we cannot pay all the sum - so we want to pay in installments.

In case mediation fails, they will file a suit for recovery of money under Section 138 of the Negotiable Instruments Act. It would be best if a detailed response to their suit is prepared well in advance to avoid any adverse directions. Further and better particulars are needed for an effective opinion.
