Can i add amount with interest on blank cheque.

I HAVE GIVEN 310000 RUPEES TO FOR GRANITE BLOCKS PRODUCTION FOR AN INTEREST OF RS.2%. HE HAS GIVEN A BLANK CHEQUE. I HAVE TO RECEIVE 1.5 YEARS OF INTEREST RS.18*6000=108000 CAN I WRITE 310000+108000=418000 ( FOUR LAKHS AND EIGHTEEN THOUSAND ON THE CHEQUE AND DEPOSIT IN MY BANK ACCOUNT FOR COLLECTION. AS THE PERSON IS NOT GIVING THE MONEY . HE SAYS HE WILL BE ARRANGING PAYMENT WITH IN SHORTLY. BUT NOT GIVING.

You can definitely file a section 138 proceeding. Since his signature are on the cheque, he will have to prove that you did not owe him money. Burden of proof will not be on you. In terms of time frame, it can take anywhere from 1-5/6 years for the case to get decided assuming the accused denies that he owed you money. The legal fee would vary depending upon the experience and expertise of you lawyer you engage.
