Builder Rent chq for Transit Rent Bounced.notice served

I have given notice to bldr.for Transit Rent(part pyt ). amt 2 lac. of (1 lac chq each) on 27/Dec/2025. which was dishonored. What is the time limit to file Suit. After Notice Period. + legal Court fees .+. Advocate legal fees..to file Suit against Bldr Total Rent pending upto 31/ Jan/2026 Amt. 6.95 Lac.

Cheque dated 27/12/2025 bounced. Issue legal notice u/s 138 NI Act within 30 days from return memo date. If payment not made within 15 days of notice receipt, file complaint within next 1 month. Civil/Order 37 recovery for ₹6.95L + interest & costs also possible.

Since your cheques were dishonored and you have already sent a notice (presumably the 15-day statutory notice), the clock is ticking: Waiting Period: After the builder receives your notice, they have 15 days to make the payment. Filing Window: If they fail to pay within those 15 days, you have exactly 30 days from the date the 15-day notice period expired to file a complaint in the Magistrate's Court. do not delay. cheque bounce case can be filed against them. Stamp duty of 2% has to be paid while filing the case. Notice fees and Advocate fees are different. so a total of Rs. 50,000/- will be the costing for filing of case. (Excluding Stamp Duty charges). Upon dishonour of the two cheques of ₹1 lakh each towards transit rent, the remedy under Section 138 of the NI Act must be initiated after expiry of 15 days from receipt of statutory notice, and the complaint must be filed within 30 days thereafter, limited to the cheque amount of ₹2 lakh. For recovery of the entire pending transit rent of ₹6.95 lakh (till 31 Jan 2026), a money recovery suit can be filed independently, within a limitation period of 3 years from the date the amount became due. Court fees are payable as per state rules, and advocate fees vary based on jurisdiction and complexity.

On cheque dishonour, issue demand notice within 30 days of bank memo. Drawer gets 15 days to pay. If unpaid, file Sec 138 NI Act complaint within 30 days thereafter. Civil recovery suit limitation is 3 years. Court fee depends on state.
