Person issued dated cheq for me and before issed date he complaint the bank that issed dated cheq was missed.that his complaint effective and adventage for him and against failig cheq case to him

he needs to file a declaratory suit against u or similar suits claiming the same lost and needs to prove the same also. Another remedy is tat he shall register an FIR on tat aspect . Other wise his claim wont stand a chance. After executing the same he cannot simply deny the debt. There are a bunch of cases with similar occation. Execution of a cheque is a kind f agreement where the executant promises the bearer that there will be the amount mentioned available iin the concerned account. So unless otherwise proved the chrqur stands live even the accouny itself got compromised. N in ur case wat the defaulter is doing is that he is inder wrong impression making evidence for non payment of ur debt. Do present cheque through ur branch n initiate NI act proceedings at the earliest. Do temember validity of cheque is 3 months from date f cheque hope am upto ur query
