Accused did not pay money after accepting fault in the court

I had received chqs from a party against material supplied to him on MOU mentioning the details of cheques nad the date of deposit. Party has differed the payment, he had orally committed in front of the court that he will pay 25000.00 per month against the above cheques for which I had filed a case u/should 138 in the JMFC court. Now he is avoiding the payments after giving from mar,16 sept,16. Now please advise me if I can lodge a FIR in police for the same chqs not MOU U/S 420 NOT 406 BREACH OF CONTRACT, PLEASE REVERT IMMEDIATELY. REGARDS

yes you can file a case against him and file a complaint as well. the MOU also stands void now as he has not taken appropriate steps. you can even move an application in the court where 138 matter was going on and issue summons to the accused again.
