Can i apply in the Apex court for demanding Pension dues

Sir, I belong to Ex Emergency commissioned officers cadre.we were released and observed in NCC. Our terms and conditions were same we were to get one encrement less than the army officers and our pension was as per civil pension rules 1972 but to retire at the age of 55 yrs.Up to 2009 we were getting the same pension but in 2009 PCDA reduced it. Put us in PB-3, in 1992 Supreme Court has ruled after being aproched to revise our retirement age to 58 as we were to get pension as per civil rules.MOD Government of India has said on affidavit that we are not defence civilian we belong to special cadre. As such Apex court ruled that we are not defence civilian and civilian pension rules are only for calculation purposes. MOD/ Government is not honouring this judgment and not putting us in PB-4.please consider the Merits of the case. Pl also advise if we can approach the Apex court. Is the case time barred
