Army personnel not giving money to family and threatening family

10-Nov-2023 (In Armed Forces Tribunal Law)
My father is a retired Army officer (Havaldar). It's been more than 7years of his retirement and just after the retirement he started working in a private firm as a security adviser. He worked there for around 2 years and after leaving this job the real mess started. He started ignoring us(children) as well as his wife. He started living separate from us from last 2 years without any judicial separation. We did not make any issue regarding this just in thought that it might hinder the family name and respect. But now the things had gone more worse because he does not pay a single penny to his wife and not even any kind of attention. Whenever my mom tries to bring the things back to normal, he just reminds her that he is from the ARMY background and she can not do anything against him. Is this right? Does an ARMY tag makes a person do anything? Do you think this is tolerable?

Dear Client,
There is nothing as such a distinction between a person from army or from any other background. Your mother is completely entitled to claim maintenance from his husband. If you need any further clarification for the same feel free to contact.

This situation is not tolerable, An Army background does not mean one is immune to law of the land. An Army person has to follow the law even more strictly. He has a duty towards his family. You or your mother can approach the courts and demand maintenance from him for your selves, since you are his dependents. This is your right as per law. After passing of Court order, his pension will be divided and a share will come to you. So too his other income and you will also be granted share in property for your residence.
