Paid for settlement to agent but now bank again asking to pay
24-Aug-2023 (In Arbitration Law)
I (Lalesh) was Holding a ABM AMRO Credit card in 2008, which had a outstanding amount of 77,000 Rupees. As I was not able to make the payment, had agreed for settlement. The settlement amount was 58,306 which was paid in 2008 October. The collection agent gave an excuse saying, he did not carry the Settlement letter and will be sent to my mail. I did not receive any mail nor the Collection agent answered my call. As days Passed , I Forgot and thought it is cleared. Meanwhile the transition happened from ABN AMRO -> RBS (Royal Bank of Scotland) -> Kotak Mahindra . I did not get any calls till July 2017 for this issue. In 2017 July, I received a call asking for settlement and I did not agree. I did ask for the phone conversation (IVR) recordings, which happenned between me and the bank , but this Kotak guys are not listening and they are denying to provide the same.In August 2017 (today), I got a call from some Lawyer saying an Arbitration case has been filed against me. please suggest.
Please consult the bank higher authorities and convey about the settlement happened in the year 2008 and mention since that day you have not used your card as it was blocked and you were not made any transaction. Just remember if you have got any acknowledgement if you have got for the settlement done and remember how you settled it through cheque or cash. If you have given cheque then take the bank statement to show them that you have already settled it.
