Court asking to make payment in favour of proprietor can I challenge

09-Feb-2023 (In Arbitration Law)

An arbitration award went in favour of a Company "A' represented by its Proprietor Can this award be enforced if the Company has closed without assigning its right to any one. I made the payment by a cheque in favour of company. But the court is insisting on making payment to the Proprietor in his personal name. Under what sections of law, can this be challenged. Any rulings of any court?

If you are using the term 'proprietor' it tells that was a proprietary concern means a single owner concern and a proprietor and the proprietary concern is no different.

If you are being directed by the court to pay the money to the proprietor in his personal name towards satisfaction of the award, you will surely get the protection later and you need to discuss with your present lawyer so that things are properly recorded in the order sheet, for you to take benefit of it later, if dispute arises.
