CHANCES FOR GEETING ANTICIPATORY BAIL UNDER SECTION 306

09-Sep-2023 (In Anticipatory Bail Law)
Case is 5 years old .FIR was logged after 9 month from incident under section 306 and 376. We ourself approached for DNA test and it was negative. Hence section 376 was later abolished by police. But section 306 is still on us. What are chances of getting anticipatory bail from high court?? Also, whether settlement between us and family of victim happens then whether it will help? What legal option available to avoid getting arrested?

Sir, if your case is good, there are good and fair chance to get bail from Session Court as well as from Hon'ble High Court. Many thing have to be taken in consideration like statements of the prosequtrix, statements of other witnesses etc..

you have a good chance to get the bail as the ingredients of section 306 is not fulfilled and basically no case is made out against you. if tou go for compromise certainly your case would be over and you won't have to spend time and money in further litigation
