Anticipatory bail in Odisha High Court Cuttack or Sessions Court

In a 498 A IPC Case, can we apply for Anticipatory Bail before Odisha High Court, Cuttack or we have to apply before Sessions Court in our district.

You can directly approach the Honourable High Court of Orissa, Cuttack. You can also approach the Sessions Court of your district. It is advisable that you should approach the Honourable High Court of Orissa for Anticipatory Bail. In 498 A IPC Cases Anticipatory Bails are generally granted if there is no any other grave offence. Yes, in a case under section 498 A of Indian Penal Code you can apply Anticipatory bail before Odisha High Court under section 438 of Criminal procedure code. Though both session Court and High Court having power to grant anticipatory bail you filed it before Odisha High Court, Cuttack
