Q: Wife filed a false 307 case against me

Hi i am jaspreet who married in jan2015.i have one baby boy who born in jan2016.In april2016 she filed cases against me dowry/domestic violence/maintainece etc. I am giving her 5000rs every month from last one year as a maintainace after court order. Now 24th july 2018 she raised FIR against me 307. I was in hotel party on that time and i am available on cctv. But police not ready to accept this. They are not collecting proof which is on my favour. I am not arrested yet applying for anticipatry bail but its declined twice. What should i do in order to proof myself as innocent. Police against me and my wife asking 25 lakh to remove all this otherwise she will keep continue to doing this. I am not rich and but yes i am innocent.

Advocate Vipin Rathee answered
First of all apply for anticipatory bail so that police can’t take action against u.. at evidence level u can give application in court to call CDR (call detail records) from service provider and do ask the party venue owner for cctv footage.. these are going to be vital evidences.

Q: Illegal Construction in DDA Flats

1. A DDA flat has illegal construction which is projecting dangerously in front of the entrance of my flat, I have been complaining since 2005 to DDA, MCD, Police, Home Ministry and Public Grievance they are doing nothing but rather making excuses not to take any action like we did not get Police Force, its compoundable, there was a shortage of time, now they are making excuses using the NCT Delhi provisions Act is in force we cannot do anything. 2. In response to my RTI, MCD provided me certified copies stating structure is illegal and non-compoundable and cannot be legalized. 3. Now the illegal structure has developed cracks and pebbles fall from it from time to time which is a threat to my life and property. 4. Please help hw to get the illegal structure demolished.

Advocate Vipin Rathee answered
You need to approach civil court citing danger posed by this illegal structure. Do submit all the documents which u procured through rti. Court will direct authorities like mcd and Delhi police to act as per legal provisions prescribed in law.

Q: What is procedure for settlement of loan with the bank

I had two personal loans and now i have some unwanted circumstances pertaining which I am not able to pay EMIs and now bank people are harassing me what can I do?

Advocate Vipin Rathee answered
You have two loans running against you. In the present scenario where you are not in a position to pay EMIs, you can have a word with bank people to settle for some minimum amount. Bank people can't harass you for non payment, in this case FIR can be lodged against the bank people.
