Advocate Vikrant Guleria answered
Yes it is very easy to make him punish for all his wrong deeds, you can file for divorce filing a proper petition in proper court along with all the relevant medical documents n all the complaints you have filed against them (husband n in-laws) in the police station. N, yes you can approach to CAW Cell, but it is of no use, after so much of cruelty, caw cell is good only if you want to get settle with him n want to teach him a lesson. Or, else just contact me thru my profile for further information.
Q: How to fast track a divorce case
sir I have filled a case in Delhi high court of cleared to the divorce..my wife cooperate in 1st of motion of divorce mutually.. but for 2nd motion she is demanding money...so I filled a case in Delhi high court and my judgement is reserved from more than 6 month..it's not passed till now..I am feeling mentally pressure..plz tell me what should I do to get quickly judgement..
Advocate Vikrant Guleria answered
look, if the Justice of the Hon'ble High Court has reserved your matter for order/judgement, it is the whole sole discretion ofthe court as when to announce the order/judgement. or the court can recall your counsels along with you for clarifications regarding doubts in the said case filed by you. Though, there is nothing you or your counsel can do in this regard, it is the power given to the court by the constitution of India, or probably the court might be waiting for the police to complete their investigation. Q: What should I do if my brother is threatening me of false SC/ST case
Mai New Delhi se belong karta hun. Mere chhote bhai ne SC ladki se shadi ki hai. Vo ek anti-social element hai. Vo mujhe dhamki deta rahta hai ki mujhe apni patni se SC/ST case me faswayega, iske saath hi usne jhoothe dowry case me bhi fasaane ki dhamki di thi. Mai SC/ST case ki dhamki ke liye kya kar sakta hun?
Advocate Vikrant Guleria answered
dear, look if its your brother alongwith his wife is threatening you with dire consequences, the step you should take is firstly record the abuses either oral or verbal abuses, make a video or audio recording of the same whenever such threatening is made to you again, and on the very same instance call at 100 and file a complaint against the miscreants to the police. and, wait for a week or so so that police can proceed with the investigation, still if nothing comes out of such practice, you can file a application under section 156(3) Cr.p.c. seeking direction from the court for police protection and make your complaint into an FIR. for further information, visit my profile, probably can help you with more clarity.
Q: Received a challan for dangerous driving but I do not have a licence
Hi, I received a challan for dangerous driving, no drivers license. My question is do I have to show a drivers license in court. Or is it just paying penalty and they don't see drivers license or insurance?
Advocate Vikrant Guleria answered
yes it is very important to have a driver license in such cases. though as soon as you appear before the court, the judge on first instance will demand you for your driver license . And as you mentioned, you ain't have driving license issued in your name , you can be penalised with "life imprisonment'' according to Indian laws. As it is compulsory to be competent to drive a vehicle on Indian roads. for more information you can visit to my profile for further inquiry.
Q: Warrant Issued but the accused moved to a different address
In my cheque bounce case, the court has issued bailable warrant against the accused. however, the accused is absconding so that the summon and warrant is not served. However, post the warrant is issued by the court, I have information abt the new address. Is there any way we can change the address in the current warrant. Else we will have to wait for the next hearing and there are high chances that accused will change the address again.
Advocate Vikrant Guleria answered
Under negotiable instrument act, you has filed a case, in which firstly you have to send a legal notice, that means accused is well in knowledge that you have approached the doors of court. Therefore it will beneficial for you as a ground in your arguments that he deliberately changed his address. Though, you or the counsel has just to file an application regarding supply of fresh address where summon is to be served. For further enquiry you can contact me through my profile.
