Q: Construction of room with bathroom by builder for his own purpose in c

The land is a total of 500 sq yards. The Builder ( he is also the landowner) by constructing 10 flats (3BHK) in 5 floors and sold the flats. He gave parking in the cellar to 10 owners and five more parking areas were left with him. Now in that parking area which he is claiming as belongs to him , he wants to build a room in the cellar in that parking area. By claiming that remaining 5 parking areas are belongs to him, the builder now constructed a room with bathroom apart from the Watchmen room. Question is - when he sells the entire 500 Sq yards, how can he build a construction on the land which he already sold. He is claiming that the five parking areas belong to me, nobody has authority to question me. How can he claim that? As a common rule, parking areas are not included in the built-up area. So by using this he is claiming that the parking areas belong to me. But he is alien to that land as he sold the entire land. Without any possession of the land, how can he build a room

the builder cannot make any construction in the parking area as per the municipal laws. it is only ment for parking by the flat owners only.if the builder has already parted away the entire flats along with the undivided share of the land to the flat owners then the builder will not have any right to calim the parking area. because he has parted the entire area to third parties by way of registered documents along with undivided share of the land, the builder will not have any right over the parking area which is being claimed by him unless he the owner of the any of any of the unsold flats.

you can file a suit against your brother claiming the rights over the joint family property that is the property left over by your late grand mother for partition. you have to make all the legal heirs of your grand mother as parties to the suit. for any further advise contact.



Q: CAN I BUY A FLAT ON THIS DOCUMENT?

Can i buy the flat which is built in the 467 sq yards with out any permission, In the vali colony, tolichowki hyderabad.. If documents 670/2020,671/2020 of Golconda SRO... How can i know the land documents are clear?? They said they applied for permissions.. & told yo register all flats(15 flats) at a time.. Can i stop some amount till registered??

Any illegal construction is not permissible under GHMC Act. you have to purchase the flat only after looking in to the permission, valid title documents etc.I don't advise you to purchase any flat without the permission of the concerned authority.for further advise you can contact.

My grand father purchased a house in 1983.He has 4 sons and 2 daughter.2nd son is my father. We lost him in 2006 in an accident.There after my grandfather said the house is ours. But he didn’t write any will.He died in 2010.After he expired my brother took the house papers with out my consent n my mother concern he sale the property to his friend in 2017 . In recent days I came to know all these. I issued a notice to them that I have a ryt in the house.
