Q: regarding common stairs usage with owner of house

sir i have 4th floor with terrace purchased from owner of whole property now i want to know that stairs of my floor and terrace is under my rights or the owner because they are saying that because its not mention in paper so sthey can use stairs for their use like shoe stand and ol this

The stairs starting from your fourth floor still the terrace of the property is under your ownership right and you have the right to use the same. Whether the same is written or not on papers. Still if you can get a document/ addendum added to the sale documents and can file a police complaint in case the owner is disturbing you.

Q: Daughter rights on property, can daughter claim her right

Hello, I wanted to know can daughter claim on father's property even if father has died in 1989

Earlier as per the hindu succession act, 2005, the daughter had right over the property of her father only if the father had died in 2005 or after. But now, Yes as per the new amendment made by the hon’ble supreme court of India, a daughter can claim a right over the father’s property even if father has died in 1989.

Jo apke pita ki property hai uspe apki sisters ka bhi right hai, but kya apki sisters ne apke parent’s ka dhyaan rakha tha unki old age mein? Ya kabhi unki bimari mein unko apne pass rakha tha?Agar to apki sisters ne aisa kuch ni kia hai to apke aur apke bhaiyo ke chances zyada hai property mein share ke. Baki apne kuch poochna ho to mujhe call ya message karein.

Q: Ex wife's claim for maintenance and right in my husband's properties

Can my husband's ex wife and 14 year old daughter claim maintenance and share in my husband's properties which he inherited through gift deed and will from his grandmother. She has taken one time settlement for past present and future maintenance from my husband 7 years back. Can my husband gift me his properties to avoid any future problems. I too have a son from my present husband.

As per your query, I would like to ask whether there is any settlement agreement which was entered between your husband and his ex wife? Also, please let me know whether the same was settled by the court or any court order. Is there any proof which can establish that your husband has give a one time settlement amount to his ex wife.
