Questions Answered by Advocate Vaibhav Tyagi

Q: Can NCLT be referred after appointment of official liquidator

Can a comapny make reference to NCLT after official liquidator has been appointed ?

Advocate Vaibhav Tyagi answered
It depends on what capacity is the NCLT being approached, whether it is by a new creditor or by the Company itself through the Official Liquidator. Another important point to be disclosed by you is whether the Liquidator has been appointed by the NCLT or by a High Court under the earlier law (Companies Act, 1956 or Companies Act, 2013). It is requested that the query be more specific, mentioning the above-details along with for what purpose do you want to approach NCLT. This will help in answering the query effectively. Thanks.

But after working there for 3 months i quit the job without informing the company as i am facing health issues due to night shift working. Now after 1 month of leaving the company i got a letter to pay the amount of 1 Lakh to the company within the 10 days period of letter issued date else the matter will be forward to the legal department of the company. So plz help me out what to do in this case??

Advocate Vaibhav Tyagi answered
Hi, the bond signed by you with the Employer is enforceable before the court of law, therefore, it is advised that you reply to the said letter with appropriate medical certificate substantiating your reason. You are also advised to go through the terms of the bond and how the amount of Rs. 1 lakh is payable by you, whether it is specifically stipulated that you are to pay the said amount or the Company has made some additional payment demands.
