Q: Can my mother choose her choice of lawyer from legal aid

Hi I am rather confused about something. My mother is planning to file a judicial separation soon and is finding a lawyer currently. I want to know if she approaches the district legal aid centre for legal aid , does she have the freedom to choose her own lawyer or does she have to go with the lawyer that the centre appoints her?

Thank you for your query. Your mother has a free will to appoint any lawyer as she feels apt for her. However if she requires assistance from legal aid, lawyers are assigned at random according to the field of service.



Q: Is section 138 NI act is effective for filling case on cheque bounce

I gave some one the amount worth 10 crores..For that he has given me cheques and the affidavit also...But now since the cheques have been bounced..Is section 138 is effective because I have not seen any worry on his face since he has political and administrative approach.. sir/madam does cheque bounce cases are effective

There are certain factors to look out for, firstly if the amount you gave is a legally enforceable debt and secondly if the cheque issued to you was to pay back in part or fully that amount back. If these conditions are met, then you have a strong case under section 138 of NI Act. However, you must act fast as the first requirement for filing a case is to send a legal notice within 30 days of the return memo.One cannot run or hide from court proceedings.



Q: Divorce procedure for an NRI if marriage is not registered in India

Hi...I live in New Zealand, I got married in India - Delhi 2 and 1/2 years ago however my marriage is not registered in India or new Zealand...my wife has left me without giving any concrete reason as this is not the first time she did so...I don’t own anything in India, what would happen if I want to leave her..,do I have to file for a divorce and if so can she demand alimony even though we don’t have any kids. I am a temporary citizenship in NZ which will get permanent in 1 year at that time if I choose yo leave my Indian citizenship can I still be pursued in INDIA for a divorce case. My parents own a property can she claim rights on that.

Thank you for the query. You can file for divorce in Delhi as your marriage took place in accordance to the Hindu Marriage Act. With regard to the maintenance of your wife, it depends if she is earning for herself. Irrespective, she will file for temporary maintenance. Your wife does not have any right over your parents self acquired property, however if any of it is ancestral, then yes, she can claim her right over it.

I m a hindu married woman. It has been 11 years since our marriage. We don't have a child because of non serious attitude of my husband. He don't want to plan a family.What legal action I can take against him?He is a govt. employee.He has non serious attitude towards other important issues also.

You can file a Complaint under the domestic violence act, and even further if you desire, you can file for divorce as well. In the end it depends on how serious of an action you would like to take against your husband.
