Q: Legal action against neighbours who are constantly creating problems

Sir, I am a 20-year-old girl studying medicine from a well-educated and disciplined family. We are currently living in a rented house. My parents and I have been facing constant problems from our neighbors. They are always trying to dominate us, create unnecessary fights, and behave very badly, especially with my parents. For the past 4 years, we have not even spoken to them, yet they continue to mentally harass us. There is no peace at home because of them—we can't even sleep properly due to their behavior.

As a girl, my parents ask me not to get involved in such matters, but it’s very painful and shameful to stand by and watch this happen. I want to help, and I want this to stop. These neighbors act as if they own the place, even though we are also tenants like them. Their torture is becoming unbearable.

It would be helpful to know the exact reason behind the frequent quarrels. If your neighbours are threatening you or causing mental harassment to your parents, there are several legal remedies available.

You can file a written complaint at your nearest police station, clearly explaining all the details, including how they are creating problems, making threats, and mentally disturbing your family.

Q: To whom should I appeal against the order of District Forum

Respected senior lawyers, Kindly advise me that whether I can prefer an appeal directly to National commission against the order of District forum, if the ground of appeal involves the pecuniary jurisdiction of the National commission. More precisely, if the case is decided by the DCF without its pecuniary jurisdiction which is vested with the NC, then can I prefer appeal to NC directly or not? Or should I prefer appeal to SCDRC to refer the case to NC. Regards

An appeal can be preferred against the order of district forum to the state commission and from state commission to the national commission .whether applicant has filed an application on the correct forum or not is to be decided by the district forum at the earliest. If the application exceeded pecuniary jurisdiction the district forum is not entitled to entertain the application.
