Questions Answered by Advocate Swati Goswami Dhawan

Q: Where can i apply for a parole

I am serving life imprisonment u/s 302 ipc, Appeal is dismissed from supreme couet also. if I wants to attend daughter's marriage, so where and how i can file parole.

Advocate Swati Goswami Dhawan answered
For getting a parole, you will have to file a writ petition before the High Court. Alongwith the writ petition you will have to annex the wedding card of your daughter and the letter from the venue saying that the marriage is due for the date fixed. There are few other things that needs to be taken care of on the basis of the facts of the case. You can contact me in case you wish to file the writ petition, as it may take some time for the court to dispose off the mater.

Q: I lost cheque signed by me someone filed cheque bounce case

dear sir I have lost my cheque that is filled only amount of 32000 and sign by me it is incident of Jan now in Nov I received a call of some one says that it cheque is bounced and I m going to court or u pay me 15000.i lodge a computerised f I r same day and date mentioned on of Jan month. Now what can I do.. bank are not working any other work else cash work. Plz provide me soln.

Advocate Swati Goswami Dhawan answered
Hii..If you have already filed an FIR then it should not be a problem for you. It seems that someone is trying to get the money from you which is actually not due to him/her. The other thing is that a cheque is valid and can be presented before a bank within six months from the date and as the cheque is of January, it is no more valid in November.Though from your query it is not clear if you had intimated the bank as well about the cheque being lost. Kindly update me on that part. The person who is blackmailing you will have to first send you a notice in order to initiate a legal action against you which will have to be replied. For any further queries you can contact me.

Hii.. It is not clear from your query that when your mother remarried and whether the property is self acquired or ancestral in nature. Also please inform your date of birth. As far as the share is concerned you will have an equal share in the property as your brothers, but the situation may change on the facts of the case. For assessing that, please provide us with the other details in order to help you further.
