Questions Answered by Advocate Sumit Kansal
Q: Insolvency CHD Developers case Gurgaon
I have a house with CHD developers in Avenue 71 and my case in NCDRC has judgement reserved . The apartment is ready for possession but we have not taken possession yet as we are waiting for NCDRC Judgement. What will happen if the builder goes into insolvency meanwhile as some buyers from other project 106 Golf avenue have taking buyer to NCLT
Advocate Sumit Kansal answered
In such a scenario, you will need to file an application before NCLT, stating that order of NCDRC has come and that you can get the possession of the flat. However, for this you will need to wait up till the ncdrc order comes.....you can get in touch with me for handling the matter.
Q: Legal Issues with working with client independantly of hiring company
Hi,I have been contracted by a company (say ABC) to provide certain services to their clients. I also own an LLP (say XYZ) which provides this service (in addition to others). The contract with ABC does not have any non-compete clause. I have been assigned a client by them who is very unhappy with the overall company processes of ABC and wishes to engage with me independantly of the hiring company. He will be disengaging with ABC entirely. Is there a legal issue in working with the client through XYZ since I was introduced to them through ABC?
Advocate Sumit Kansal answered
Does not appear to be any issue per se, as there wasnt non compete clause and further u contracting now in LLP capacity...You could send me the contract, to look for any risk for you. I am an Advocate cum CA, can advise u adequately.....
Q: client is not paying for the material delivered
HiI sent some material to my client 3 months back as per the PO sent my client. Payment terms was 30% adv, 70% at the time of Delivery. Now at delivery time, client was saying that he will pay in a day or 2.but Even after regular followups, still the full amount was not paid by client even after 3 months of delivery. Now suddenly after 3 months , client is saying that the Material was short in Quantity and they will not pay for the short quantity.Client is a Very Known MNC. Please advice what to do. thanks
Advocate Sumit Kansal answered
Hey, for this matter, it seems that the client is a pvt ltd co and your claim is more then 1 lakhs. Would advise to file the matter before NCLT of appropriate jurisdiction for faster disposal in few months, a Sec 9 petition under IBC shall be filed. But before that a demand notice under Section 8 needs to be served to the opposite party. I am Advocate and a qualified CA and can help you with the same. Regards
Q: Serving notice period in a psu
I am working in a psu and currently in probation ( just completed 4 months service). But, recently I got a job in my state. So, I wanted to ask that is it necessary for me to serve notice period, since it is not mentioned in service bond separately, they have just mentioned minimum period for resignation is 3 months.
Advocate Sumit Kansal answered
No, since you are in probation, generally the settled law is that no notice period needs to be served from your end. However, you mention that min period of 3 months is there, which document I would need to peruse once. For further clarifications, you can get in touch with me.
