Q: POSH Implementation, ICC Composition and its chairperson

We are a start up with 14 employees with 4 women employees who are with 5-6 years of experience only and there is no senior woman manager available to act as the chairperson of ICC. So can we go for an external female lawyer or consultant for this role and induct one woman employee with two more employees in this committee of four?

Dr. Sudhir Ravindran answered
if you do not have a senior member to be the chairman of the ICC committee you can appoint an external member who could also be a lawyer to be a part of the committee the chairman of the committee doing so complaint the posh policy if you want any further clarifications do let us know

Q: Purchasing products and refurbishing will it cause copyright violation

If am running a company and buying a variety of products from different consumer, then refurbish or recondition and sell it as a Refurbished product,is it gonna trademark infringement,? Ex: Am buying a Hot Wheels Car from a customer , refurbishing and selling it as a refurbished Hot wheels car on a website, Is it gonna cause me any trademark or copyright violations?

Dr. Sudhir Ravindran answered
A trademark right is typically exhausted by the first sale of good or placing the same in market. The basic principle is that once the right holder has been able to obtain economic return from the first sale or placing in the market, the purchaser or transferee of the goods or services is entitled to use or dispose it of without further restriction.

Q: Legalities to host online audio portal

Am planing to host online audio portal like ganna, just like to know what are legal i have to follow new songs to play on my site

Dr. Sudhir Ravindran answered
You need to get license from right holders of the music you intend to play or sell on your site. You can also approach collective rights organisations who would provide license for the same on behalf of the owners or right holders of music

Q: Took property from married person can his children and wife ask for it

THIS CASE IS REG-WASTE LAND PURCHASED IN CHENNAI- ramasamy (late) has two wifes 1.amaravaty 2. thanjammal. & amravaty son Ethiraj sold peice of land(3 cent) to me. now second wife of late ramasamy daughters caliming that first wife son ethiraj sold property without our knowledge so deed of sale is not valid... MY question is i bought land from 1 wife son ethiraj who sold without the knowledge of their siblings.. now ethiraj recd court notice asking property partion between all ( 1 & 2nd wife childers) will there be issue in my purchase ? will they snatch legally from me ?

Dr. Sudhir Ravindran answered
If the property is self acquired by the person selling then there is no problem. If it is an ancestral property then all legal heirs have the right and the two wives and children have a claim. Your title and sale would defective if all have not signed. If there minor children it complicates the matter further.

Q: Procedure to sell property without the consent of one of the co owner

the property is in the name of mother .now the mother and 4 of her sons and daughters as legal heirs willing to sale and ready to put their signature except the one elder son.as they are in need of money what is the procedure to sale that with out the consent of that son

Dr. Sudhir Ravindran answered
All legal heirs have right in the property including the children. It is essential the son also signs otherwise your title and sale would not be valid. It is not possible to the deal without the consent of the son.
