Advocate Sreeram Viswanath K answered
A Writ Petition asking the concerned authorities to consider your application seeking can be filed. Once directed by the High Court to consider your application, the concerned authority can either accept or reject your application. If the application is accepted, you can continue with the construction. If the same is rejected, you can challenge the rejection before the High Court.Kindly note that the advice is based on limited facts. Mere challenging of the rejection order before the concerned High Court does not automatically provide approval. Kindly consult an advocate and provide complete documents to enable the advocate to understand the facts better.

Q: Builder delaying hanover of the flat quoting war as reason
I gave advance to buy a flat in Jan 1st week where the MD and sales team mentioned they are planning for interior handover by Feb 20. During aggreement of sale in Feb in agreement it was mentioned as Mar31st when questioned about it they mentioned they will be handing over for interior before the date mentioned. Now it it end of june but till now no handover and quoting war as reason for delay where in Agreement 6months grace period is mentioned due to natural calamities, war, etc.
Advocate Sreeram Viswanath K answered
Force Majeure conditions such as act of god, war etc., generally depend on the local conditions and not international conditions unless specifically mentioned.Unless the builder is importing something from the place of war that is used for construction and that is stalled due to natural calamities, war etc., the builder cannot take the defence of force majeure. The advice is based on limited information that is provided. Kindly contact an advocate by providing complete documents so as to enable the advocate to understand better.
Q: Property case about daughters and son
It is about father's property, they are 4 daughters and 1 son.the plantiff is daughter and defandant is son and remaining 3 daughters are inactive.the father had died without will, but defandant create a fake will produced in court, the one of witness says that I don't remember what happened on the day of will . I don't remember who were present on that day.i don't seen thir father sign on that will.i don't remember who were present he says like that.then who will get favour plantiff or defandant.
Advocate Sreeram Viswanath K answered
The burden of proving that the will is genuine is on the person who claims that there exists a will. In the event that the person is not able to prove the genuineness of a will, the Court will not consider the will and partition the father's estate in accordance with the applicable law amongst all the legal heirs. The advice is based on the limited information that is provided. For better resolution kindly contact us by providing complete information so as to enable us to understand better.
