Q: Issued a wrong certificate due to lack of awareness.

My mother applied for an OBC certificate in delhi through tehsildar when I was in 9th class, but now when I am in class 12 , I got to know that I belong to the 'Dhanuk' caste which is a scheduled caste in delhi(as confirmed from the official document by the central government). I want to change this certificate, I have never used reservation benefits till date in any exams or admissions.

Q: Correction in DOB required for CBSE - Class Xth Board.

Dear Advocate,Greetings!!I would like to meet you to discuss a change in DOB in the records of CBSE required for my Son who has passed Class Xth from CBSE board in the year 2018. The DOB in hospital records, birth certificate issued by municipal corporation, Adhar Card, Voter ID card, PAN card are correct.As you are already aware that a court order is required to make any amendments in the CBSE record for the cases where the passing year is more than 1 year.Please suggest how to go about

Sir you have to file the civil suit of mandatiry injunction in which you have first cancel the first certificate which was issued and then the court order concern authorities to ussue the fresh certificate



Q: Wife filed 498a, DVC and divorce and in live in relationship with her

My wife filed false 498a, DVC, divorce and is living with her ex boyfriend from last 2 years. Her idea is to obtain divorce and get married to her boyfriend but want to harrass me for rest of cases, I as husband want to either prolong the divorce cases or file criminal case against her. My questions are1. As a husband can I file police complaint against wife for live in relationship with another man without obtaining divorce. 2. Will police accept my complaint. If not how to proceed further.

Husband cannot file any criminal case against his wife but you can file divorce petition against your wife. if their is settlement arises in the divorce petition then you can file the divorce by mutual consent



Q: Chargesheet Filed and date is also given in trial

I applied for anticipatory bail but my anticipatory bail rejected also my chargesheet is filed and lower court given first date. So whether I need to apply for anticipatory bail? What is chance of arrest?

after filling of chargesheet generally bail is granted. but you have to apply for surrender cum regular bail application. Generally if accused appears on summons bail is granted, actually arrest is very rare in matrimonial disputes.



Q: Filing a writ petition in Delhi High court, want to know about e-stamp

I have to e-file a writ of certiorari in Delhi high court. The only issue is regarding the stamping. If I want to e-stamp it, do I need to buy judicial e-stamp? In Delhi, court fee for writ of certiorari is Rs 100. So, should I just attach judicial e-stamp of Rs 100 on first page of writ petition? What is the fee for annexures, affidavit, urgent application and no-filing declaration? Do I just need to buy judicial e-stamp and attach them to respective pages. Does affidavit need notarization?

for e filling before High Court of Delhi, you can affix Court fee both ways. you can either annex the e Court Fee Or pay it online. for Annexures there is no Court fee, but if you are filling Certified copies of Court record, you have to pay Court Fee 65 paise per page. for all applications the Court fee is Rs. 3.00 per application. all the affidavits which are required to be filed in Court requires atteststion from Oath Commissioners appointed by High Court.
