Q: can husband and wife live separately without divorce ?

I have been married for 10 months. I want a divorce from my husband and want to move on in life. Our personalities and thinking don't match. How can I file for divorce? Can I stay separately from him without getting a divorce? How to live separate without divorce in India? Can he file a case against me for living separately without divorce?

you can stay separately without divorce although your husband can file a case under section 9 of the hindu marriage act for restitution pf conjugal rights. Also in cases of less than one year of marriage for divorce due permissioneof the court is required.



Q: How to get custody of 2 yr old daughter from cheating wife?

My wife has an extra marital affair with her boss and continues with the relationship even though I have objected to it many times . Finally I am left with no other alternative to divorce. She is ready to give me a divorce but not the custody of our 2 year old daughter. Our daughter is one good thing about our relationship and I do not want to part from her . Kindly help

Hi, As per the Hindu Law , since your daughter is two years old the custody of the child goes to the mother, however in your case you can be helped by bringing into picture the extra marital relationship your wife which shall form one of the grounds of divorce and articulating the same facts before the Court which will help you in getting custody of your child. Also to help you further , it is important to know the details pertaining to the background of your marriage and marital life.



Q: non Payment of electricity bill by tenant how to recover

My tenant recently vacated the premises on 18th july 15 appx 11.00 p.m. He got electricity bill till 16th july 15 i.e. 28 days which he has paid. But problem is that, he is denying to pay for extra 2 days (on average basis). Is he right legally ? please help. thanks

Hi,Two days is acutally a meagre period, however you can write to him personally asking him to pay for certain units consumed within those two days by him. you do not have any such remedy legally since the time period is too short.



Q: wife has filed dowry case in india and i am in usa

sir i m reside in usa after marriage i went their on tourist visa after spending 7-8 years i hv 2 kids but after some years on small issues my wife started fighting with me and then she came back to india and now she has filed dowery case and harrasment case against me nd my parents . so pls suggest what to do i m still in usa . i tried to contact her but she didnt. what r legal consequences and what can i do now from there. pls help me . how she can harm me and my parents they have nothing to do with her as she lived with them only 5,6 days after marriage pls suggest me solution frm usa
