Q: Restrictions in armed forces of India

Is it right to restrict any armed force personal from attaining higher education qualifications by the department and also to restrict him and not to give permission to appear in the exam for a job of his desire.

there is no such restriction but first apply for seeking such permission after which the department may give you permission for further studies. such restrictions are necessary order for the discipline and requirements of the defence forces

Q: Can Practising Advocate present Application for Operational Creditor ?

In NCLT Can Practising Advocate represent Application for recovery for Operational Creditor under section 9 of Insolvency Resoluction Process?

Yes. In nclt an advocate can file petition on Behalf of operational creditor under Section 9 of Insolvency and bankruptcy code. AND it is advisable to file through an advocate because of legal intricacy

Q: Harassement by builder in gurgaon - booked a plot

I have booked a plot at gurgaon 10 years back.At the time of booking they promised in the broucher , which is part of agreement to sell that they will provide state of rat club,land scape school, market, warer bodies etc etc.even after 10 years nothing is provided.even sewer, warer. elecricity connection came few moths back.As per them they recevived OC four years back which they must have manipulated to save them from panalty .My questions are :Can i ask refund is offer of possession valid since no facilities are ready i shoud file the case in NCLT, NCDRC, CRIMINAL, RERA.

You can file the case in rera or nclt, which will be better options. Ncdrc may not be your option because of the jurisdiction. In criminal case, you will have to wait longer and so best will be nclt. You will need to have all your documents ready and compiled.

Q: Sub inspector letral deprtmental exam in crpf

Sir i m serving crpf personnel having rank counstable in crpf. Sir central reserve police force has not been organised ldce exam for its departmental candidates since 2016 and other paramilitary forces such as bsf & ssb etc organizing vacancy every year for its departmental personnel . I mailed many time and he gave me a reply " as per directions of Hon’ble Apex Court, while framing separate Recruitment Rules for Group ‘B’ & ‘C’ posts in Mahila Cadre, DoP&T has raised certain observations in proposal submitted by the department. The clarification and amendments are awaited from MHA/DoP&T. Further, amendments in RRs is co-related with Male & Female, therefore, vacancies of LDCE will be released only after amendment of Recruitment Rules."Sir its take too many time taken by mha and dopt but doesnot dispose this matter as yet. Sir plz what can i do for organiIng vacancy of si for ldce personnel as soon as possible. Plz suggest

First of all, this does not pertain to armed forces tribunal. Such case will have to be filed in the high court. You will have to meet in person for further details. A detailed representation will need to be given. Thereafter, writ petition will need to be filed
