Q: Query regarding need to register a logo/ name for a self-owned service

Hello there, I am an artist looking forward to sell hand painted / graphic art of my own creations on different medium (ex: T-shirt , posters, etc). I use a logo and a name of my page to tag my works. Do I need to get it registered somewhere? Is there a chance of an unknown claiming the name or the logo is his/her anyways?

You need to get your logo / trademark registered with the Trademarks Registry. There are different categories in which applications are filed depending upon the goods or services under which the registration is sought.

Q: What action do I take against a girl blackmailing of filing false case

Hello sir/ma'am, I received a threatening message from a girl for filing a false case against me (not explicitly), but I know it, as I have never done anything wrong at all, I want to file a case against her for threatening/blackmailing. It's already been more than 10 months when this incident happened, but I'm in total mental stress due to her insensitiveness. My doubts are 1. Whether she can really file a false case against me? (How to tackle with such false claims, because as far as I have read, In such cases court considers the girl to be victim until proved otherwise) 2. What are my chances of winning the case? (I have all the proof ready with me) 3. Can court punish her since she is not in India anymore, studying in Australia.

Dear QueristIt all depends on the nature of incident and the time of its occurrence. In usual circumstances if someone is threatening to file a false case against you then the first logical thing is to file a police complaint against the said person stating that she is threatening to file a false case.

I want to withdraw the case from consumer court.what is the procedure.

Just file a simple application to withdraw the case. In most cases the forum also allows to withdraw the case on oral request during the hearing. Withdrawal is not difficult if pleaded by the authorized Peron or advocate.

Q: Can I become proprietor of my firm

Sir I have a partnership firm and I want to remove my partners from the firm and become my firm to proprietor is it legally possible .please help me by answering me question.

Dear QueristThe same shall depend on the type of partnership deed you have executed with the other partners. Whether the partnership deed is registered or not and further what are the relevant contents of the deed. A partnership firm otherwise can be dissolved and you may start the business as sole proprietor.
