Q: Grand father property partition among siblings
Grandfather has 3 sons & 2 daughters, he shared his 16 acre as * 3 acres for them till their life & after that it belongs to 3 son's(oral communication not in written) * 3 acres for each sons * 2 acres for each daughters. Grandparents are no more now, Before 20yrs, 1 son got separated frm his family (2kids) but not legally. So he registered his share 3acres in his mother's name and sold out the property. While sharing the grandparents share among 3 sons, do daughters hv rights in this share?
Advocate Raj Munuswamy answered
Hi I've just gone through a brief message of yours Aashi according to the succession act and the family Law it is very very clearly given that grandpop that is the father's property goes to Sun Sons property goes to grandpa grandchildren so in this particular scenario one son has taken a due advantage and he is not equally shared the property with the other siblings which is completely against the law definitely you have all grounds to go to the court and get your exercise that is exercise you're right you can definitely claim your rights

Since the OS suit was filed without including the correct survey number (missed earlier),File an application for a stay order on the disputed land to prevent further construction/alienation.File a petition to amend the OS suit and include the correct survey number immediately.
Advocate Raj Munuswamy answered
Sir or Madam over is the request please note that the property dispute is a civil nature you cannot expect any remedy from the police station all you can do is a complaint if they refuse to take the complaint you can send the registered post with an acknowledgement to the station saying that this this property belongs to me and this is this is an encroachment but for You sure shot the remedy should be only through court you have to go to the court and through court only you can get the remedy
Q: Husband and wife disputes - dowry
After being constantly harassed by her mother-in-law over dowry, my sister left her husband's home 10 months ago with her two children. Her husband, who was unsupportive, recently filed a police complaint against her and our mother, claiming they refused to return home. During the initial police inquiry, the police seemed to side with her husband. My sister fears for her mental health and wants to live separately with her husband, but he refuses. She needs time to heal, next hearing 30.09.2025.
Advocate Raj Munuswamy answered
Mum I've gone through the brief note of yours please advise your sister that she may not go to the station this is a civil matter that a family matter police doesn't have any jurisdiction Police can call and advice on a good faith but they cannot take sides and they cannot do if a police call tell them I'm not prepared to come to the station whatever they wanted to Do let them do it to the court family court okay so tell her not to worry everything will be in favour of your sister so therefore tell her to approach the right advocate and send a notice about what domestic violence has done then I think whoever is close to your locality jurisdiction they should be able to guide you okay thank you
