Q: Filed in Canada for divorce and has to come to india

We got married in india and then my wife moved to Canada. With mutual consent, she has filed for divorce in Canada which is to be sent to India. Wanted to check how can I check where the documents are and how much time will take to process the r documents in india and would be handled by which organization in india ?

If you got married in India and still you are living out of the India if you are taking diverse out of India that is not valid in India until unless some legal observation that requires so it's better if both the parties are living out of India were wherever we are leaving they need to take divorce in India there is no requirement of any of 1 to come to India for taking the divorce without coming to India you can take your diverse so it's better you need to aware about the legal rights and the rule of regulation of Hindu marriage act



Q: Husband teats like servant cannot tolerate anymore.

Hi, I need a legal help to come out from my marrige. It was a love marriage but always compromised in my regards and wishes. I was always treated as a nonpaid slave. I am working but I never get a chance to use my salary or income to use for my needs. For my hard earned money was controlled by my husband. This was not enough here I am not having any right to ask r do anything with out my husband knowledge. If I do anything without his knowledge he will get angry and scold like anything. My biggest pain is hear everything from his family member no matter is younger them me. I am always colparit without hearing truth. I have to hear everything from him and his family without any complaint. Have keep happy his all member his mom-dad, sister, brother, brothers wife and Thier kids. No matter what cost ot is I have to pay for their all wishes. I have a 3 years daughter he never never do anything for us. I am in that stage that I sould get divoce or do suicide..

Q: Whether i will get my money back from my husband

My husband filed section 9 against me from Mumbai after 1 month i filed 125 crpc maintenance case from Bareilly.I have 2 months old son that's why i didn't go to attend his hearing .1 year of arrange marriage only.My parents gave 10 lakh cash money but no proof and some gifts.Iam working and husband is working.Whether i will get maintenance for me and my son?nWhether i will get money and gifts back ?nWhen to file interim maintenance?

Yes u can file the case of maintenance before attending Attending counselling of the things are different to each other so you can file case of men tennis in 125 CRPC in family Court or you can get men tennis in domestic violence case in Mahila Court

Hello sir if your wife left the house you need not required to worry don't worry if she filed a case of domestic violence every case has its own feedbacks she can claim some relief in domestic violence case and there you can find your own case of divorce on the basis of cruelty made by your wife desertion made by your wife so you have your option open so need not to be worried you need to worry about only the maintenance if you are working or not working still you need to pay the men tennis dear wife and son so it's better first of all you need to face the domestic violence case or you can side-by-side filed a case of divorce as well



Q: Does MOU Offers 100% Protection From False Cases/Police Cases?

Wife filed false dv case and i filed counter case due to which she wants to close both cases and now wants MOU to be signed. I would like to know what protection does MOU offer to husband and his family from such fake case/police case. The judge knows the dv case is almost false and persuaded wife to agree for MOU and start living. However, I had many apprehensions as she filed a false case and it lead to my mental harassment and lot of money got spent in defending cases and filing counter case. Based on evidences, I have almost 95% evidences to prove in court that she lied on multiple cases and keep fighting the dv case for 4 to 5 or maybe 8 years.On the other hand Judge and mediation wants both parties to settle amicably and start living after MOU. My questions: 1.Does families get restored and live happily after this MOU is signed?2. Does it offer 100% protection from any such fake cases/police case.3) What points should I definitely include in MOU if we agree. Kindly suggest.

there is not any kind of MOU which can protect ones benefits only in case of mutual divorce it can help .in mutual divorce only u can put some condition which will help u for safeguarding the first motion and second motion
