Q: Mutual divorse signed but getting problem with advocate for forward th

Me and my wife having some serious family issues and she filed 498a case ..after 3years she come to compramise for divorce in my village ..with other persons help I agree to give demanded amount to mutual divorse..then I was given half amount of money..they given one letter remain amount will take at the time of divorce but they demanding total amount want now..both the parties have same adovate he was not helping me..he supported to her only..I was only paid money for both of us..ot he was not taking any action for forward the case.. please help me

you can in such cases take no objection from the advocate and say that you want to appoint another advocate and half amount is given on the day of signing on mutual consent papers and the remaining balance on the closing day

Q: Emotional harrasment during pregnancy

My husband was constantly demeaning my family for not doing the marriage properly.. he is constantly picking fights with me even when I told him it's harmful for my health as am in 9th month of pregnancy. Please help me.. he threatened to take away the baby if I applied for divorce.

Hi,you first move to your maternal home. After delivery you think of the next plan of action regarding his deeds of constant fights and quarrels with you. At this critical juncture your prime importance is to your health and nothing else.

Q: In laws not allowing me to get into my matrimonial home

Me and my husband have been staying in a seperate home nearby to my in laws place. Currently my husband is working in Aus and iam working in India. I have a daughter 2.5 years old. Few days back my in laws abducted my daughter as she used to stay with them while I working. Due to a small rift I had with them they refused to give my daughter back and have threatened to kill me if I come to their home to meet my daughter. Even after pleading them and my husband they refused to return her. Even as last try I went to their home to get my daughter back but they necked me out. I was left with no option but to file a police complaint. They handed over my daughter to me, I have come to my moms place as now I have threat that they may harm me and my daughter. I have locked my flat and came but when I went to take few of my belongings I see that they have put another lock on the door grill. Can I break open the lock that they put to stop me from entering my home or should I take help from police

Hi,You have every right on your daughter and in case they forcibly do anything or threaten you you can record such conversation and as well go fir a police complaint. if the house you stay is locked by them and your items are in the house you can as well take the help of police people and break open the door. of this type of attitude is continued by inlaws and husband you can file a police complaint 498a

Q: my wife taking revenge on my parents

My name is srinivas (37years) my wife name is Jyothi (35years) and having two kids one boy (9years)and one girl(6years), we done the love marriage (intercaste marriage), parents not accepted while we r in love and suddenly we both gone to arya samaj and done the marriage and now its 12years over of my marriage. so my concern is when ever i taking care of my parents then my wife and me getting disturbed and she dont like my parents and she feel that my parents are not accepting her and now a days she is blackmailing me that she will sucide if i taking care of my parents. so i don't want to loose my wife and my kids because me and my wife love each other very good also love my kids very much, so i want to be happy with my parents and as well as my wife and kids, so i need advice how to go-ahead for this type of problem.

Hi,your intention of keeping up family relationship and as well as taking care of parents is very appreciable. you can just convince your wife and take her to a family counselor and discuss the pros and cons so that she could come out of insecurity feeling that your parents donot accept her or a feeling that you get attached to them and ignore her.

Q: I want to send a notice to my wife for divorce

She left from me six months back i approached her at their home with my relatives two times and my relatives went two times but they dint respond to me.I took cops to her house before then she told no allegations on me small misunderstanding .after that also she dint come then i sent a legal notice to her to come and join with she replied to me full of allegations and she was telling finally she wants to keep family separately . I replied to that i will not gonna setup family at Bangalore you can come and join with at my native place for this no reply.After that i approached her with mediators but no response. now i decided to send a notice to her for divorce.

instead of sending notice for divorce send her notice on RCR Restitution of Conjugal Rights so that she has to come out with a reply. if she doesn't come out with a reply institute a case basing on RCR then she will come out with correct intention. whether retrieving back to her matrimonial life or staying back stating she wants to keep family seperate will come out from her mouth
