Q: How to get advance booking money back from the builder?

I have booked an apartment. An amount of 7.27 laks have been transferred through bank to... account before GST. This project has not been started. After GST they put 12% GST as per law. Now the cost of same apartment has been increased by around 11 lakhs which I am unable to afford. I mailed them to cancel and refund my money. They are saying that your money will be forfeited as 10 % BSP. which is equal to booking amount. They say it is as per my application form agreement. I am working in myanmar and never sign their application form. They themselves sign the application form. I told them that I will be visiting India in December to see site and sign sale agreement. No sale agreement has been signed by me as I am out of country. They are fraud. I need my money back with interest. How to proceed ? How much time it will take to settle? How much will be your charges including everything Kindly reply

You can either file a case before the State Consumer Redressal Forum/ Civil Court with jurisdiction/ Real Estate Regulatory Authority of India ( provided it is notified in the State). The quickest remedy would be Real Estate Regulatory Authority(RERA), and then Consumer Forum and Civil Court in order. You can also file a summary suit for recovery of money in the civil court.



Q: Can Court Grant stay for implementation of Section 9 post Act 3 2016

can a court grant stay the implementation of award where arbitral award passed against any government body or corporation after amendment in arbitration act . need a judgement ?

Yes. The court can grant a stay on the award. The party challenging the arbitral award must also apply for stay. Reference may be made to Section 36 of Arbitration and Conciliation Act ( post amendment)



Q: Validity of a pending case after SC Judgement nullifying it.

As IT act section 66a has been struck down by SC . What to do in scenario of pending case in lower court and lower court is not taking note of it. Advice me with a suggestion which is low in cost

You can file the copy of judgement in the lower court and show it to judge. If not taken cognizance of, you can file a writ proceeding before High court having jurisdiction to restrain the lower court from passing any judgment against you and directions to take SC judgment in cognizance.
