Q: Quashing of a Frivolous FIR against me & my wife

A frivolous FIR was done to harass me & my wife by a builder entity with whom I used to do business. Chargesheet has been filled but i want to get it quashed as i have to apply for Canada work permit

Yours being a commercial dispute, FIR can be quashed by High Court on merits. It would be a time consuming process and the chances of success can only be ascertained after analyzing the relevant documents.

Q: Is there a need for specific POA in case of legal representation

I am complainant in cheque bounce case , proprietor is my brother he gave me authority in writing on paper that I can file and proceed case against accused whether such authority letter is valid or general or specific power of attorney is needed

Hi. In case of a proprietorship firm, a formal authority on the letter head of the firm under signatures of complainant (which in this case is your brother) and stamp of firm would suffice but it would be good if your brother (actual complainant) appears in witness box to give evidence to avoid any technicality.

Q: Can girl file a complaint if we have done sex chat on WhatsApp

Sir mene ek ladki ke sth sex chat kri hai or ek private pic send ki hai wo acche se reply kr rhi thi pori baat kr rhi thi. Sir agr bo koi complaint kr de to kya fas sakta hu wese mere pass pora proof hai hai ki wo bhi acche se bat kr rhi thi.

Hi. What ever chats or proofs you have would be of no use once a complaint is filed. If a complaint is filed against you, you have no choice but to approach court. What ever proofs or photos you have would be helpful in trial only.

Q: Time limit to file charge sheet under section 420, 406 and 66A

Hello sir..mere cousin or uske kuch frdnz ko cyber cell ki team ne arrest kia tha 25 jan ko.. FIR me section 420 406 and 66A lgaya h.. to is case me chargesheet file krne ki maximum time limit qa hogi? or bail kitne din me possibl h becoz jb se leke ab tk sirf dates mil rahi h court se

Hi. The time for completing the investigation and filing the charge-sheet/Final Report is 60 days if the alleged accused persona are in police custody. Grant of bail totally depends on the actual facts of the case and the role described by the police in the charge-sheet. Chances of getting bail can only ascertained after reading the relevant documents and evaluating the relevant facts.

Q: Someone withdrawn money from account through ATM without card

Sir, Someone has withdrawn money from my account thru ATM in RK puram Delhi. But that time the ATM card was with me. I have not shared PIN / CVV with anyone. I am residing in Ghaziabad.Kindly let me know where to register the FIR,as Ghaziabad police denied to register FIR. Kindly help , I have lost bigger amount & I am in urgent need of money. Hi. This is a subject matter of investigation. Since the crime took place at R. K. Puram you may file the complaint with PS R. K. Puram. PS R. K. Puram also has an effective cyber crime department. In addition to this a separate representation should also be given to the beanch manager of your bank. In case of such cyber frauds the bank is bound to return the defrauded amount as they are entitled to recover the said amount from the culprits.
