Q: If I can travel should I challenge pending PCC

I renewed passport and I received it valid for 10 years. Now, police are keeping my PCC pending. They say there are pending private heirlooms theft complaint by my uncle -- false complaint my uncle is using to bargain. I not been served any summon. Should I go to court -- I can still travel, what if I keep PCC pending?

File a Writ before High court. it is settled law that unless there are FIRs, you cannot be stopped from travelling. if there are private comolaints and no court has imposed any comdition to seek permission before travelling, you can proceed to travel in that case

You should preserve all evidence, including screenshots, call logs, and any deleted or recovered messages. Based on your facts, you can pursue the following legal remedies:1. File a complaint with the Cyber Crime Cell and local Police Station under BNS and IT Act for online harassment, stalking, and criminal intimidation.2. Initiate proceedings under the Protection of Women from Domestic Violence Act, 2005, as the continuous abusive conduct by your ex-husband amounts to mental and emotional cruelty.3. File a civil suit seeking a restraining order/injunction restraining him from sending further abusive messages, calls, or any form of communication.4. If the offensive messages or content have been forwarded to any family member, common acquaintance, or posted publicly, a criminal complaint for defamation can also be filed, since such acts harm your reputation in the eyes of others.All complaints should be supported with documented evidence for stronger enforcement.

Hi. What ever chats or proofs you have would be of no use once a complaint is filed. If a complaint is filed against you, you have no choice but to approach court. What ever proofs or photos you have would be helpful in trial only.

Q: Quashing of a Frivolous FIR against me & my wife

A frivolous FIR was done to harass me & my wife by a builder entity with whom I used to do business. Chargesheet has been filled but i want to get it quashed as i have to apply for Canada work permit

Yours being a commercial dispute, FIR can be quashed by High Court on merits. It would be a time consuming process and the chances of success can only be ascertained after analyzing the relevant documents.

Q: Is there a need for specific POA in case of legal representation

I am complainant in cheque bounce case , proprietor is my brother he gave me authority in writing on paper that I can file and proceed case against accused whether such authority letter is valid or general or specific power of attorney is needed

Hi. In case of a proprietorship firm, a formal authority on the letter head of the firm under signatures of complainant (which in this case is your brother) and stamp of firm would suffice but it would be good if your brother (actual complainant) appears in witness box to give evidence to avoid any technicality.
