Questions Answered by Advocate Pulkit

Q: Local Guardian requirement at university of Delhi

Hello,Is there any lawyer who can help me with "local guardian" rule in University of Delhi?Moving from miles away, I have no relatives in the NCT region for local guardian affidavit and hostel form. Is there any legal way to handle it, such as submitting a parent undertaking or a self-signed affidavit instead? can a lawyer help resolve this through legal channels or court intervention?

Advocate Pulkit answered
The requirement of a local guardian is generally based on the University's admission or hostel policy and is not a statutory legal requirement in every case. If you genuinely do not have any relative or guardian in the NCT of Delhi, you may approach the University/Hostel authorities with a written representation requesting acceptance of a parent/guardian undertaking or any alternative permitted under their rules. If the request is rejected arbitrarily despite genuine circumstances, legal remedies may be available depending on the facts of the case. An advocate can assist in examining the applicable rules, making a representation to the University, and, if necessary, taking appropriate legal action before the competent court.

Q: Affedevit for legal guardian at university of Delhi

Hello, can anyone inform me whether the affidavit for the legal guardian, required for university admission, must be signed in the presence of a notary, or if I can simply provide the stamped affidavit to my guardian and request their signature?

Advocate Pulkit answered
Generally, an affidavit should be signed by the deponent in the presence of the Notary Public or Oath Commissioner, who verifies the identity of the deponent and attests the affidavit. It is not advisable to get the affidavit notarized first and obtain the guardian's signature later, as this may affect the validity of the notarization. However, if the concerned university has issued any specific guidelines, the same should also be followed. For advice based on your particular requirements, you may consult a local advocate.

Q: Query Regarding Maintainability of SLP Prayer for Reference to KRERA

Respected Learned Advocate(s),I seek your considered opinion regarding the most appropriate legal remedy available after dismissal of my Consumer Complaint by the DCDRC, SCDRC, NCDRC and the Review Application by the NCDRC.Throughout the consumer proceedings, my principal prayers were for directions to the Builder to furnish mandatory documents, execute the Apartment Buyer's Agreement/Sale Deed, facilitate housing finance, complete the sale transaction and deliver possession.

Advocate Pulkit answered
Based on the facts stated, once the Consumer Complaint has been dismissed by the District Commission, State Commission and National Commission, and even the Review Application before the National Commission has also been dismissed, the next legal remedy may be to examine the maintainability of a Special Leave Petition (SLP) under Article 136 of the Constitution of India before the Hon'ble Supreme Court, if there are substantial questions of law or jurisdictional errors. Depending on the facts, it may also be necessary to evaluate whether any independent civil remedy for specific performance, execution of the sale deed, possession, or damages is maintainable, provided it is not barred by limitation or other legal principles. Since the appropriate remedy depends upon the complete record, orders passed by the Consumer Commissions and the reliefs sought, it would be advisable to obtain a detailed legal opinion after examining all relevant documents.

Q: Process of Applications in court

wht is the process of application and reply filling We have to give direct to judge on date of hearing or all applications need to file before court hearing date and to give pp and opposite party advocate in civil caseAnd In routine does advocates send by registered post or give personally to opposite party advocate 3.in case of evidences in civil and criminal cases like any cd pendrive these also to be send to opposite party advocate while filling in court

Advocate Pulkit answered
The procedure depends on the nature of the application and the applicable procedural law. In civil cases, applications and replies are generally filed before or on the date fixed by the Court, subject to the Court's directions and procedural rules. A copy should ordinarily be served upon the opposite party or their advocate. Service may be effected personally through counsel, by court process, or by registered post/speed post/electronic mode where permitted by the Court. As regards electronic evidence such as CDs, DVDs or pen drives, a copy is generally supplied to the opposite party in accordance with the Court's directions and the applicable procedural and evidentiary rules. Since practice may vary from court to court, it is advisable to follow the specific directions of the concerned Court.
