Questions Answered by Advocate Pulkit Jain
Q: Will the pension of retired govt servant be effected by criminal case?
I am a retired govt servant. I was in Judicial custody of 6 days for false charges put against me under matrimonial cases by my daughter-in-law. Will my pension get affected due to this?
Advocate Pulkit Jain answered
No, your pension does not get affected, till the time judgement in your case comes in. if the judgment comes in positive i.e. your acquittal then the pension still remains unaffected. but if the judgement comes in negative i.e. your conviction, then it is a problem and govt may stop your pension on basis of this.

Yes, bank cannot make you guarantor for any person without your express consent and knowledge and also cannot make any one as your guarantor without your knowledge and consent. Now you should make an enquiry regarding this from the concerned bank. And also ask the same through RTI if it is a govt bank. now coming to the call you received, it make a hoax call, kindly wait and watch and further recourse can only be taken if you receive the notice. thank you
Q: Took a personal loan and credit card unable to pay now want to settle
Dear Sir, Please guide me & help me, I have personal loans of Rs 2lakhs from HDFC bank(71000) and Bajaj Finance (145000) & credit cards outstanding from 4 banks of Rs. 9 lacs. From last 6 months I am unable to pay. Now I want to settle the dues one by one. Please help. I have also sent a request mail through legal advice app. Regards
Advocate Pulkit Jain answered
As from your query it can be ascertained that you want to settle the dues one by one.It will be recommended that first you should make a income plan so that you get to know the amount you can segregate for payment of dues per month. Then find out all the dues regarding your loans aals well as credit card along with the time frame you have to pay or the time which has expired. This will help to create a priority according to which you have to pay.Now approach the banks/credit card companies one by one and find that whether are ready to settle. Few will be ready to settle and few will not. Now banks who are ready to settle, settle out with them. And the one which are not ready to settle then you can apply to delhi mediation centre to help you to get settlement in Lok Adalat. So that that settlement cannot be appealed and there will be no settle lment without your consent.I hope i answered all your query Thank you
Q: Legal validity of criminal case once withdrawn be filed again
A person has taken back his criminal case against me. Can he again file the same criminal case against me now.
Advocate Pulkit Jain answered
Although it is a theoretical query without any specific facts.Answer to your question in simple way is if a person has compromised or taken back the case in court proceedings or high court quashes the fir, then again he cannot file the case again. But if a person takes the case or writes to police he wants no action or withdrawal of complaint from police then he may again file the complaint with police to get criminal justice system in motion.I hope I answered your query!Thank you
