Q: Educational Documents Given For Job Now Not Returning My Documents

Sir 5 month ago I gave my all educational and all work experience documents to someone regarding job now he is not returning my documents and making excuses that will give you so and so date and every time give new date. Now I have fear he can do some fraud activity from my documents. Please advise what should I do.

Advocate Pronoy Chatterjee answered
file a complaint in the police station against the said person or you can send him a legal notice. if you do not act upon quickly , your documents can be misused and you will face consequences. you can directly file a written complaint to the police or you can engage a lawyer to draft a legal notice for you so that you are protected from fraud , if any.

Q: Being threatened by SBI card representatives

I have pending dues on credit card, which after discussing with representatives from SBI have been paid/scheduled to be paid. SBI cards have given me an agreement in written stating amount and last of payment to be made. Further, same has been signed and sent to SBI almost 1 week ago. However, in this past week, I have been threatened by SBI representatives to beat me and my colleagues, whom they have been calling to find my current whereabouts. Also, they have hurled abuses at me and sent me text messages which are personal in nature. I do understand this is against RBI guidelines and if there is an agreement in place already, why they are doing so? You are requested to guide me to take legal action against SBI/their representatives and hence, assure my safety.

Advocate Pronoy Chatterjee answered
Dear Sir,There is nothing to worry about as the SBI officials cannot and does not have a right to threaten you. you must file a written complaint drafted by a lawyer and also file the complaint with the Banking ombudsman appointed by the RBI.please contact me for any further query, so that we can meet and discuss the same. thank you

Q: REJECTION OF MOTOR INSURANCE CLAIM BY GENERAL INSURANCE COMPANY

I purchased a car from Mr.Govind at Ahmedabad on 14/1/19. I submitted documents in RTO Ahmedabad on 16/1/19 for transferring ownership of car in my name. All documents containing RC book and other transfer forms got misplaced in RTO. So, ownership was in the name of previous owner in RTO Records. Previous owner renewed Insurance Policy for 1 year on 18/12/18, valid up to 17/12/19. Custody of car was handed over to me on 14/1/19. On 17/2/19 car met with an accident. On 17/2/19 car ownership was in name of previous owner and insu. policy also was in name of previous owner. But due to unavailability of RC Book and other documents of previous owner I was unable to lodge the claim. After intensive search, on found of documents at RTO at 27/2/19 they immediately changed ownership in my name. I have the ownership report of RTO of 19/2/19. I lodged claim on 11/3/19, but they rejected my claim without stating any reasons and without providing rejection letter.Am I eligible to get claim?

Advocate Pronoy Chatterjee answered
Dear Sir ,you are definitely eligible to get a claim from the insurance company as the vehicle was insured and no matter on whose name the insurance was made the important aspect is that the previous owner transferred all his rights to you when he sold the vehicle and that included the insurance policy as well. please contact if you have any further query. I am very well versed with the intricacies of Insurance/consumer laws. thank you
