Q: False case filled against me for extortion by my friends uncle

I once called my friends uncle to settle a dispute arising between them it was a formal talk but he lodge a FIR against me And the talk was for one time only and for 40 seconds only But then he put a case on me on section 384, 506, 34 And made me a third party First and second party are the father and sister of my friend As he is saying I called him for extortion on the demand of my friend father Please suggest me

Advocate Priya Sharma answered
In response to your reply firstly, I have some queries from you, whether you have the recording of that call or not ? so if you have that recording then you can prove yourself or if you don't have that recording then it is compulsory for the complainant to produce that recording to prove his case. Therefore you have to attend your court hearing to prove yourself.

Q: What to do i filled a false case against my friend

Hi I lodged a complaint in 2014 against my friend regarding harrasing though it was not true as my parents forced me to do so. But no action was taken against him fortunately, I gave a written complaint and I got a photostat copy of my complaint from the PS. My friends brother is in defence he is being promoted to some other defence agency of india for which his whole family background will be check. As no action was taken by the police not even a call was done by them to my friend is it going to reflect as criminal record and if yes, so please provide me a solution to get out of it as I don't have even the photostat of that complaint

Advocate Priya Sharma answered
You have only given written complaint to the PS and no action has been taken by the police till today so there is no need to worry as there was not any FIR so do not worry. This is not incline in the criminal record but if you have any doubt then you can simply write a application to the concern police station regarding withdrawal of your previous complaint.

Q: Husband does not take any responsibility & physical & mental abuse

I m a married woman. It has been 11 years since marriage but my husband never took his duties seriously. He didn't make any effort to start our family. He did make sure that I don't conceive a baby..Also some years ago, he also physically & mentally abused me. What can I do against him. I want to punish him without giving him divorce. We belong to Punjabi Hindu family.

Advocate Priya Sharma answered
I appreciate your decision that you don't want to give him the divorce. This is the best decision so firstly you can file domestic violence case against your husband. There is no need to give him a divorce and in the D.V.Act petition, you can mention all the cruelties which were done by your husband against you.
