Q: Charging VAT on Service Charge

We had Beer at one bar in Delhiwhich was mentioned 815 Rs on Menu They charged Beer: 815 RsService Charge (10%) : 81.5 RsTotal: 896.5and they charge 20% VAT on both the particular 179.30 Rs.same thing they have done with the food also. They charge 5%GST on service tax on the Service Charge of food bill and 20% VAT on Alcohol. Are they taking this money illegally or legally?I want to complain about this where should I complain. Can I get any compensation?

Advocate Prince Bharti answered
Your query is not very clear so I would like to see the bill and then determine what kind of taxes they have charged against your food and alcohol. As per the issue of service charge it Is not a compulsory charge that is to be paid by the customer service charge is an optional one. If customer wants to waive it off the restaurant is bound to waive it. You can definitely approach the consumer forum to get relief if any wrong taxes has been charged.

Hi My wife has hardly lived 3 months with me and my family and for last 1.5 years living with her parents. She came once in last 6 months fought with everyone and went away again. She doesnot wants to live like a wife doesnot wants to build any physical relationship. She lives in patna and i live in delhi with my parents. She has files Section 406, 498A, 307& 384.She has taken al jewellery all her stuff.I had filed RCR section 9 which is still going on and had 1hearing so far, My wife on other hand had filed these cases 15 days after she got notice for rcr .I came to know it from a Lawyer in Viashali court patna .She has not sent me notice to my home address and 2 hearings have already passed. How should i go about it

Advocate Prince Bharti answered
See as per your query what I have understood is that you and your wife are not living together from past 1 1/2 year so there cannot be any chance of section 498 a because you're not living together both are living separately in Delhi and Patna. So to make other things clear I want to know about The series of events that happened between you and your wife after the marriage to help you in this Case. I think the case has been filed against you Is basically to harass you.

Dr. Ne day one se complete bed bola hai par mere in laws mujhey har jaruri chij ke liye tarsaate hai. 2 aug ko main hospital bhi admit hui thi aur jab 8 aug ko main discharge hui to mere in laws ne mera sara samaan rent par shift kar diya aur mujhey ghar se nikal diya. Ab mera husband mere sath maar pitai krke chala gya hai. Main yaha par akeli rehti hn.

Advocate Prince Bharti answered
You can file for maintenance and your husband has to pay for the expenses incurred towards taking care of yourself and your unborn child. Further you can also file a case under Section 498A against your husband and your in-laws. The Honourable Court will certainly grant relief to you.
