Questions Answered by Advocate Prashant Mehra

Q: Wish to leave company in middle of notice period can company stop me

I signed a contract with my company. The notice period is for 60 days. I have another offer from other company. but they want me to join after 40 days. So can my present company stop me from 20 more days even if i am wiling to pay for the 20 days notice period?

Advocate Prashant Mehra answered
No, as long as you are willing to forego the pay for 20 days they cannot stop you. Confidentiality, non compete and other similar clauses might however continue to apply, subject to specific terms of contract.
