Q: Can we build temple in residential area ?

People living at first floor have build a temple there, which is creating a lot of problem for the building people. my question is this legal to build a temple in residential society

Building of Temple for Public on the first floor of a Residential building is not legal. However a temple can be built in the compound of a Group Housing Residential society complex and even Public can be allowed to visit that.



Q: If FRI is registered can i get passport ?

In august, fir was filed against me for making a fake id of my friend. I wrote an apology letter with photostate of my adhaar card and my friend's father submitted in the police station where they filed the complaint. Its been 5-6 months to the incidence. I need to apply for passport. So do i need to mention anything there. If i tick no there and when the poilce will come for verfication what will happen. I have not told my parents about fir filed against me. What should i do ?,can i get passport if i have fir against me ?

You need to show the FIR for further consultation. Is that FIR produced in court as yet? Who had filed the FIR? Was it in known to your friend or not? Who had complained about this in the Police? Please give complete details.



Q: Restaurant in residential area creating problem people living there

There is a shop at ground floor of my house . One person has open restaurant in that shop because of whivh all the smoke of making chowein etc comes at our balcony due to which it is very difficult to breathe.. can I take any legal action relating to it ?,can any one open restaurant in residential area?, And my house is in residential area

You can very well take a legal action. you also have to check up wheather the building is Residential only or Commercial activities are also allowed ? Please show papers of your purchase of your house to suggest you to proceed further.



Q: Married daughters right in father's self earned property

Dear experts,My father died intestate leaving the self aquired house in which me, my mother and younger brother resides. My two elder sisters are married. I just want to check whether they have any right on the house as per Hindu Succession Act

If your father died intestate and there is no will then your sisters have equal right in the property. one share of each brother and sister and one share of your mother i.e., the property has to be equally divided to you, your brother, mother and two sisters. There will be five equal shares.



Q: Validity of a pending case after SC Judgement nullifying it.

As IT act section 66a has been struck down by SC . What to do in scenario of pending case in lower court and lower court is not taking note of it. Advice me with a suggestion which is low in cost

You can download the Supreme court Judgement and give it to the judge in lower court. He is bound to accept that. There is no question he can avoids it. If you submit a judgement of supreme court or high court in a trial court, the judge is bound to accept that.
