Q: What will happen to 498s case if couple agrees for divorce

I am fighting 498a case against my husband. But its already been two years and no results have come so far. Hence I am tired of the slow judicial system and wants to divorce my husband. Will agreeing for divorce affect my 498a case? I honestly have no interest in following any 498a case or divorce case. I just want to end all this. What should I do?P.S. I have a genuine case. Only stated facts and no lies. My husband mentally tortured me for dowry but now he is playing victim, taking advantage of the general idea that 498a cases are mostly false. Personally I just want to end all this and start fresh as I have no faith in India's slow and inefficient judicial system.

Advocate Pooja Marwah answered
Hello Mam,I understand what you are going through as per the recent scenario and functioning of courts and all. Normally, in this matter nothing much happened. If you have decided to go for a divorce with your husband, then, you can talk to him regarding whether he is also interested or not as divorce will only be done when either both or one party is ready. If you want to know further, kindly contact to have discussion.Thank you.

Q: No action by police for theft (proof available)

My friend came to my house and left house on Nov 26,2021... He stolen my Samsung galaxy tab S7... I tracked the location... It was showing last location near my friends house(Faridabad) on the same date he left my house i.e. 26Nov 8:02pm... After that time my device got switched off I asked him to return but he didn't... I am 100% sure he stolen my device Because it showed last location of device in Faridabad, my friend (theif) also lives in Faridabad but I live in New Delhi, chhattarpur area. I filed FIR and also went to police station but my investigation officer did not take any action and said he could not do anything.. I gave him proof as well i.e last location using location tracking by Samsung's find my device... How can I proceed further?

Advocate Pooja Marwah answered

Q: Police not registering FIR, considering the case as suicide

Someone in the family fell from 4th floor of a building and died. His wife is claiming suicide, but there was no reason for him to do that. There's no note, and the wife herself found him lying in the back-street when she went all the way to the back-side of the terrace and saw him from above. The wife was evading police in giving her first statement at the hospital and has not been in contact with the in-laws at all, rather, has gone back to her family. Neither the wife nor family inquired about the last rites of the victim. There are multiple other small things that are weird even if looked at from a neutral point of view. The police have kind of decided that its a suicide case and are not ready to register an FIR at all. No interrogation/strict questioning of the wife has been done.We have filed a writ petition in High Court regarding this matter and prayed to the court that the case should be handed over to the crime branch or senior staff.Anything else left to do?

Advocate Pooja Marwah answered
Hello,There was no need to go to high court first when you have the option of getting the fir registered from the court itself. This has to be done in the first place as law has given the option where police does not register the case then court registers the fir. You can contact me if you want to discuss.Thank you.
