Q: Neighbour claiming that the parking slot assigned to me is his slot.

Hello Sir, I bought an apartment in 2011. And I gave it for rent till now. My tenants are not having a car and never used the car parking so far. It is vacant until now. I moved to my own flat recently and wanted to use the parking slot. But when I checked my neighbour wiped of the number what was there and wrote his number and using the parking from very long time. When I enquired I came to know that he did it long back and telling everyone that builder assigned this parking to him, not to me. At this moment I don't have any parking. And even to complain about it to someone there is no registered body in my apartment. Request you to provide some guidance on how to take it forward and get my parking back. Thanks in advance for your time and help.

Advocate Peddireddi Kalyan Rao answered
RESPECTED SIR, PROBABLY THERE SHOULD BE MENTION OF PARKING FOR YOU IN YOUR REGISTERED SALE DEED. YOU CAN FILE PETITION BEFORE CONSUMER FORUM SHOWING YOUR DEED OF DOCUMENT FOR APPROPRIATE RELIEF. YOU CAN ENGAGE AN ADVOCATE AND GET ISSUE NOTICE TO YOUR NEIGHBOUR WHO DENIED PARKING FOR YOU.

Q: Do gift Deed need consent of adopted son

My grand mother (my mother's mother sister) and his only adopted son executed a partition deed in 2008 after my grand fathers death. After that my grand mother executed a gift deed in favour of my mother for her house in 2010 and after that in 2012 we purchased 300 Sq. Yards site from my grand mother. In both registrations we don't take any concent from adopted son of my grand mother. She only done the registrations in favour of my mother. Is there any legal issues with adopted son of my grand mother in future?

Advocate Peddireddi Kalyan Rao answered
Sir, you have stated that your grand mother and his only adopted son executed a partition deed in 2008 after your grand father death. Subsequently, when your grand mother executed gift deed in favour of your mother for house in 2010 and in 2012 you have purchased 300 sq.yards site from your grand mother, there is no need for any consent of adopted son and there is no legal issue with adopted son of your grand mother in future. However you may have legal advice from local advocate for any appropriate relief according to Law.
