Q: Bought a property but her son filed a case to claim his share
I purchased a land from a lady of my village. That lady got the land from her husband and husband was also alive at the time of land purchase. Registry was done and we handed over the money too that lady. But mutation is still pending. Because her son's filed a civil suit against his mother stating that she is selling our anenstral property. Now we are in trouble because we paid money and now they filled suit too. Her mother collected money and now she is in safe zone and her son's filed suit against us that this sold land has our share too. Pls suggest what will happen. What about our money that we paid and what about that land. Her children says that their father can not transfer whole land to his wife.
Advocate O P Yadav answered
Childrens have right in ancestral property. Father can not transfer whole land in favour of his wife. He can transfer only his share to his wife . There is something wrong in the transaction you have done.
Q: What to do if friends father harasses his wife and his children
I have a friend whose father is continuously harassing his wife and two children for no fault of theirs. He has a drinking problem and is abusive as well. He is hell-bent on making their lives miserable. He does this on a daily basis and threatens them as well. His psychotic behavior even led to a broken engagement of one of his children. He threatens them that if they take any action, then the consequences will be fatal. He is under depression but refuses to take professional help or his medicines. Please help!
Advocate O P Yadav answered
Wife may file police complaint in women cell/ police station. She can also file court case against her husband under Domestic violence Act and or under Indian Penal Code. Legal action is the only remedy in such cases.
